Comey’s Memo, How Many Laws Did He Break?

I have been mulling this over for a few days because my first thought on it seemed ludicrous.  Suddenly the New York Times produced a story about a memo Former FBI Director James Comey wrote about President Trump trying to influence an ongoing FBI criminal investigation.  According to the New York Times, this memo showed Trump, as the sitting President, was trying to obstruct justice.  The date and time of the memo seemed really wrong to me.  After that memo was written, James Comey testified under oath that he had not experienced any attempt at obstruction in any investigation from the White House.  If the memo existed, that meant James Comey had perjured himself while under oath.  That is a felony.  As I listened to better legal minds than my own, a bigger question entered my mind.  Comey’s memo, how many laws did he break?

Now this comes on the backdrop of the entire Russia colluding with Trump fiction that is being created by the deep state.  We can step back to Dec 9 when the CIA leaked a bogus report to the Washington Post that Russia hacked the election.  This story is out of control and completely fictional.

The first fact is that the CIA was referring to the WikiLeaks release of the DNC and Podesta emails.  They claim the Russians hacked those emails and used WikiLeaks to release them to influence the elections.  What is missing?  All of the emails are real 100% legitimate.  They show the primaries were rigged for Hillary Clinton against Bernie Sanders.  Oh, and that the DNC organized the violent protests during the spring and summer of 2016 at the Trump rallies.  Not only that, but they instructed the protesters to dress as Sander’s supporters to further discredit him.  Then it also showed the mainstream media colluded with DNC high ranking officials to publish propaganda in support of Hillary Clinton.  That is just the DNC emails.

The Podesta emails gave a deeper look into the corruption surrounding Hillary Clinton.  It let the public know that Hillary gave very different speeches in private to the too big to fail Wall Street banks compared to what she said to the general public.  Those emails also revealed that the Clinton campaign colluded with the mainstream media to create propaganda to keep the public ignorant and compliant.  Then of course it showed that John Podesta took part in spirit cooking.  That is an occult practice that is akin to satanic worship.  That sparked the entire #PizzaGate fiasco.  I only wrote two articles on that because it seemed like a red herring.

So the deep state’s claim is that Russia hacked the truth and released it for the public to read.  That was evidence that the Trump campaign colluded with the Russians to win the election.  Of course the FBI never got to check the DNC email server.  The DNC chose to let a private cyber security company called Crowdstrike do the forensics work.  Crowdstrike blamed the Russians, but they have been caught doing that with no verifiable evidence on multiple occasions.  Then the Podesta emails, well he got caught in a simple phishing scam.  I guess when your password is password, your tech security is not all that great.  Sure, it took some Russian geniuses to break into that email server.  Whatever.

So here it is, a week after President Trump fires James Comey from his position as FBI Director and evidence that Trump attempted to obstruct an ongoing investigation surfaces.  Does anyone else smell a turd?  I am actually getting more and more critical of President Trump.  The Syria bombing and escalation is not what I voted for.  AG Sessions is doubling down on the failed war on drugs and that will just be a waste of money.  Trump has too many neoconservative and too big to fail banker Cabinet members and that is a problem with me.  But I can’t sink to the level of the New York Times and create scandal against Trump out of what should be Comey’s criminal behavior.

According to the New York Times,

Mr. Comey shared the existence of the memo with senior F.B.I. officials and close associates. The New York Times has not viewed a copy of the memo, which is unclassified, but one of Mr. Comey’s associates read parts of it to a Times reporter.

“I hope you can see your way clear to letting this go, to letting Flynn go,” Mr. Trump told Mr. Comey, according to the memo. “He is a good guy. I hope you can let this go.”

Mr. Trump told Mr. Comey that Mr. Flynn had done nothing wrong, according to the memo.

Mr. Comey did not say anything to Mr. Trump about curtailing the investigation, replying only: “I agree he is a good guy.”

And later in the article,

The Feb. 14 meeting took place just a day after Mr. Flynn was forced out of his job after it was revealed he had lied to Vice President Mike Pence about the nature of phone conversations he had had with the Russian ambassador to the United States.

Note that date in which Trump tried to obstruct justice. On May 3rd, then FBI Director James Comey testified before Congress that no attempt to impede any investigation had come out of the White House.  He stressed that if that did happen, it would be a very big deal.  In very direct words he said no investigation was asked to be stopped for political reasons.

According to the New York Times on May 16, Comey wrote a memo after his meeting with President Trump on Feb. 14.  In that meeting according to anonymous sources within the FBI, Comey wrote and shared with senior FBI officials that Trump asked Comey to stop the Russia collusion investigation into former National Security Advisor General Michael Flynn.

Wow, you just can’t have it both ways regardless of what the New York Times is telling you.  If Comey really did write that memo and it is a real document, then he lied to Senate Intelligence Committee two weeks ago.  Since he was under oath, that is perjury.

This is according to our laws.

18 U.S Code & 1621 – Perjury generally

Whoever—

(1)

having taken an oath before a competent tribunal, officer, or person, in any case in which a law of the United States authorizes an oath to be administered, that he will testify, declare, depose, or certify truly, or that any written testimony, declaration, deposition, or certificate by him subscribed, is true, willfully and contrary to such oath states or subscribes any material matter which he does not believe to be true; or

(2)

in any declaration, certificate, verification, or statement under penalty of perjury as permitted under section 1746 of title 28, United States Code, willfully subscribes as true any material matter which he does not believe to be true;
is guilty of perjury and shall, except as otherwise expressly provided by law, be fined under this title or imprisoned not more than five years, or both. This section is applicable whether the statement or subscription is made within or without the United States.
Now I don’t really think what the New York Times article revealed, if it is real, really equates to obstruction.  What Trump said to Comey in that meeting actually came across as an opinion and a request with no force.
“I hope you can see your way clear to letting this go, to letting Flynn go,” Mr. Trump told Mr. Comey, according to the memo. “He is a good guy. I hope you can let this go.”
If it was just a come on go easy on the guy type statement, can that really be construed as an order to stop an investigation?  According the mainstream media that has gone stark raving mad for the last three days, it does.  As they attempt to demonize Trump without objectively looking at any document, but only on the word of an anonymous source, Trump obstructed justice.  If that is true, then Former FBI Director James Comey committed perjury on May 3 and needs to be charged, convicted and  imprisoned for not more than five years.
I we continue down the rabbit hole it gets worse for James Comey.  If he really felt that President Trump was attempting to obstruct justice, he was duty bound to inform the DOJ.  It goes deeper than that though when you look at testimony of Acting FBI Director Andrew McCabe on May 11 before the Senate Intelligence Committee.  McCabe testified that he had no knowledge of any attempt to obstruct an ongoing FBI investigation into the Russia scandal.  It seems incredible that the McCabe would have no knowledge of Comey’s memo less than a week before it was leaked.  Worse, if the memo is real, that is another felony.
Now this is important because what the New York Times, other mainstream media, and the Democrats are claiming that Trump violated this statute.
18 U.S. Code 1503 – Influencing or Injuring Officer or Juror Generally

(a)

Whoever corruptly, or by threats or force, or by any threatening letter or communication, endeavors to influence, intimidate, or impede any grand or petit juror, or officer in or of any court of the United States, or officer who may be serving at any examination or other proceeding before any United States magistrate judge or other committing magistrate, in the discharge of his duty, or injures any such grand or petit juror in his person or property on account of any verdict or indictment assented to by him, or on account of his being or having been such juror, or injures any such officer, magistrate judge, or other committing magistrate in his person or property on account of the performance of his official duties, or corruptly or by threats or force, or by any threatening letter or communication, influences, obstructs, or impedes, or endeavors to influence, obstruct, or impede, the due administration of justice, shall be punished as provided in subsection (b). If the offense under this section occurs in connection with a trial of a criminal case, and the act in violation of this section involves the threat of physical force or physical force, the maximum term of imprisonment which may be imposed for the offense shall be the higher of that otherwise provided by law or the maximum term that could have been imposed for any offense charged in such case.

(b)The punishment for an offense under this section is—

(1)

in the case of a killing, the punishment provided in sections 1111 and 1112;

(2)

in the case of an attempted killing, or a case in which the offense was committed against a petit juror and in which a class A or B felony was charged, imprisonment for not more than 20 years, a fine under this title, or both; and

(3)

in any other case, imprisonment for not more than 10 years, a fine under this title, or both.
That is not only a felony that they are accusing Trump of committing, but it is also an impeachable offense.  They are claiming that Trump directly intervened to shut down an ongoing investigation.  Since it is such a serious charge, I in turn have to point out the even more serious charges that should be leveled back at Comey if the memo actually exists.
If the memo exists and if Comey really did feel that Trump was attempting to obstruct justice as the NY Times alludes, he is in a lot of trouble.  According to law, as a law enforcement officer, he is required to immediately notify the Department of Justice.  According to the NY Times he wrote the memo, shared with senior FBI officials, and then decided to keep it secret.  This is the law that Comey violated with that act.
U.S. Code 18 & 4 – Misprision of Felony
Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.
According to that law, Comey is being a naughty boy if he really wrote that memo.  If he wrote that memo, then he is guilty of two felonies.  On the other hand, if Comey attempts to retract from this story, and claim it was just an uncomfortable conversation, then he looks like he attempted to smear President Trump for firing him.  One path leads to jail, the other just makes him look like a petty scumbag.
Conclusion

America really needs a return to the rule of law.  Former FBI Director James Comey should be charged with two felonies.  The mainstream media needs to start reporting on the truth as I just told it, and stop trying to destroy Trump with crap.  The deep state and the mainstream media seem willing to destroy the house they live in and we live in because they are being exposed to the public.  If this memo exists, James Comey needs to be in orange.
